Authority, collaboration and access

Separate legal authority, competence and setting rules while planning referrals, supervision, telehealth, accessible services and team handoffs.

Practical referenceSources checked 2026-10-15Independent practitioner review pending

Start with the person’s goal, then consider the setting, the relevant team and the evidence. These pages connect reference material; they do not prescribe treatment or grant practice authority.

The explanations below summarize the linked sources. The planning questions are KinaVara’s editorial prompts for discussion with an appropriately qualified professional.

Authority, supervision and delegation

HHS explains that cross-state practice pathways vary with state regulation. That is one example of why a credential alone is not a complete authority answer. For assistants, aides and students, confirm the profession, jurisdiction, task and setting before deciding what supervision or delegation is allowed. AHRQ communication tools can clarify responsibility, but a handoff framework cannot create legal permission or replace a profession-specific supervision rule.

Questions to work through

  • What current statute, board rule and setting policy govern this exact task and role?
  • Who is responsible for evaluation, the care plan, delegated work and reassessment?
  • What supervision, availability, documentation and competence checks are required here?

Referrals and closed-loop handoffs

AHRQ TeamSTEPPS provides structured communication tools including SBAR, check-back, teach-back and handoff resources. They help teams organize a concern and confirm understanding. A referral is not complete merely because information was sent: KinaVara’s planning questions ask who accepts responsibility for the next action and how the referring team will know it happened. Use an approved communication channel and the applicable privacy rules.

Questions to work through

  • What is the reason for referral, what relevant information should accompany it and how urgent is the request?
  • Who receives the request, what action is expected and who will follow up if it is not completed?
  • Does the person understand the plan, and what consent or other legal basis applies to sharing records?

Telehealth location and portability

HHS describes possible cross-state pathways such as a full license, temporary-practice provisions, reciprocity, a compact or telehealth registration. It advises verifying the patient’s location and obtaining consent before an appointment. These pathways have different conditions. Do not treat enactment of a compact law as evidence that a practitioner already holds an operational privilege; verify the current issuing authority and the individual’s authorization.

Questions to work through

  • Where will the patient and professional be during the service, and what authority is required in each relevant location?
  • Is the pathway operational, is the person eligible, and has the needed license, registration or privilege actually been issued?
  • Do travel, military status or foreign education raise additional requirements that the appropriate board must confirm?

Nutrition, devices, imaging and procedures

HHS’s discussion of state-based licensure reinforces the need for an exact jurisdictional question. Separately identify general nutrition education and regulated nutrition care; fitting an orthosis and other splinting tasks; acquiring an image, ordering it and interpreting it; and ordering a laboratory test, prescribing a medicine or administering an injection. This is a question framework, not a conclusion that a particular role may perform any of these services. Existing technique pages retain their scope and source records.

Questions to work through

  • Which exact act is proposed, which legal definition applies and what source supports the answer?
  • Does the service require an order, referral, additional credential, facility privilege or particular supervision?
  • Are legal authority, competence, facility policy and payer requirements being checked independently?

Settings, language and accessible services

DOJ guidance addresses effective communication for people with vision, hearing or speech disabilities and explains auxiliary aids and services. CDC’s early-development resource also illustrates that eligibility processes differ among programs and jurisdictions. School, outpatient, inpatient, home and community services can therefore require different access and referral planning. A clinical need does not itself establish educational eligibility or insurance coverage.

Questions to work through

  • What communication format, qualified assistance or language support is needed to understand and use the service?
  • Can transport, distance, scheduling, cost or equipment prevent follow-through, and who will address those barriers?
  • Which eligibility, accommodation and payment decisions belong to the relevant program rather than the treating professional?

Safeguarding and professional boundaries

Clear communication and role assignment help make a plan understandable, including how concerns are raised. They do not substitute for a safeguarding policy. Before working with children or adults who need protection or assistance, identify the applicable reporting duties, privacy rules, consent process, boundaries and escalation contacts. KinaVara has not completed a jurisdiction-by-jurisdiction safeguarding or mandatory-reporting analysis in this hub.

Questions to work through

  • Who explains consent, privacy limits, appropriate contact and how to report a concern?
  • Which current law and organizational policy establish reporting and escalation duties in this setting?
  • Is there a documented route for urgent concerns when the usual supervisor is unavailable?

These are starting points for learning about roles and techniques. A connection does not establish that every professional is authorized or competent to provide a particular service.

Sources and limits

  • This hub does not add legal scope approvals or new state-law records. Exact supervision, direct-access, nutrition, imaging, laboratory, prescribing, safeguarding and portability answers need current jurisdiction-specific sources.
  • A payer policy, professional recommendation, certificate or employer policy does not independently establish legal authority. Expanded-profession state-law research and live compact-status maintenance remain open.
